This privacy policy is applicable to the HamWatch app (hereinafter referred to as "Application") for mobile devices, which was developed by Chico Automation & Software Technologies LLC (hereinafter referred to as "Service Provider") as a Commercial service. This policy is effective as of 2025-11-07.

1. Data Collection and Use

The Service Provider is committed to protecting your privacy. The Application does not require user registration or accounts, and we do not collect, transmit, store, or sell any information that personally identifies you (such as your name, email address, or phone number).

• User Provided Information: None. Since the Application is a paid purchase and does not offer account creation or user-generated content, we do not require or collect any personal information directly from the user.
• Precise Location Data (Access Only): We access your device's precise location (GPS data) only when the app is actively open and you have granted permission via the iOS system prompt. This data is used solely on your device for App Functionality (to retrieve location-relevant data from our public API) and is immediately discarded after use. This location data is never stored, logged, or sent to our servers or any third party.
• Automatically Collected Information (Diagnostics): The Application relies on basic, non-personally identifiable technical information for debugging. This includes:
  • Crash Data: Information related to a crash (e.g., stack trace, device model, iOS version) which is automatically handled by the iOS operating system and is not processed or stored by us.
  • Device Data: The unique device ID, IP address (used only for API communication, not logged), and operating system type.
  • Local Logging: During development and testing, a custom logger is used; however, all application logs containing usage details or device identifiers remain local to your device and are never transmitted to the Service Provider.

2. Data Sharing and Disclosure

The Service Provider does not share, sell, rent, or trade any personal information (including location data) with third parties. Only data necessary for the app to function (i.e., making requests to our own API) is transmitted.

The only exception to this is the disclosure of Automatically Collected Information (non-personal diagnostics) if required by law:

• As required by law, such as to comply with a subpoena or similar legal process.
• When they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

3. Your Rights, Data Retention, and Deletion

A. Data Retention and Deletion (App Store Requirement)

Since the Application does not store User Provided Data, there is no personal data retention beyond the life of your session. Automatically Collected Information (Diagnostics) are kept only as long as they are necessary for debugging the immediate issue, which we retain for up to 12 months in an aggregated, anonymized form.

Right to Delete: Because we do not store personal data and do not have user accounts, the primary method for you to halt data collection and effectively "delete" any local identifiers is to uninstall the Application using the standard process available on your mobile device.

B. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have specific rights regarding your personal information. As HamWatch does not sell or share (as defined by CCPA) any personal information, and only processes Precise Geolocation Data solely on your device for App Functionality, we are compliant with the following:

• Right to Know and Delete: Since we do not collect personal identifiers, your right to know and delete is satisfied by this Policy, which affirms that no personal data is stored or transmitted by us.
• Right to Opt-Out: As we do not sell or share your data for cross-context behavioral advertising, no opt-out mechanism is necessary.

C. General Data Protection Regulation (GDPR - EU/EEA Users)

For users in the European Union and European Economic Area, we process your data based on the following legal grounds (Article 6):

• Necessity for Contractual Performance: Processing the location data (on-device only) is necessary to fulfill the core function of the Application you purchased.
• Legitimate Interest: Processing anonymized diagnostics is necessary for our legitimate interest in securing and maintaining the Application's stability.

4. Children's Privacy

The Application does not knowingly solicit data from or market to children under the age of 13. If a parent or guardian becomes aware that their child has provided us with information without their consent, they should contact us at the email address below.

5. Security and Changes

We provide physical, electronic, and procedural safeguards to protect the non-personal information we process. No security system can prevent all potential security breaches. This Privacy Policy may be updated from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the effective date.
